Terms & Conditions

Overview

These Terms of Use, together with the Privacy Policy and any additional rules, policies, terms or conditions referenced herein or made available through the Services (collectively, the “Agreement”), constitute a legally binding agreement between you (“you” or “User”) and Mechanic Africa (“Company”, “we”, “us”, or “our”).

This Agreement governs your access to and use of the Company’s website, mobile applications, and related services, including any platform that facilitates the connection between vehicle owners, independent technicians, and partner workshops for the inspection, diagnosis, maintenance, or repair of vehicles (the “Services”).

PLEASE READ THESE TERMS CAREFULLY BEFORE ACCESSING OR USING THE SERVICES.

By accessing or using the Services, you acknowledge that you have read, understood, and agree to be bound by this Agreement. If you do not agree to these Terms, you must not access or use the Services.

The Company operates a technology platform that connects vehicle owners with independent automotive technicians and partner workshops. Unless expressly stated otherwise, the Company does not itself perform vehicle repair or maintenance services and is not a party to the service relationship between Users and Technicians or Workshops.

The Company may terminate this Agreement or suspend your access to the Services at any time, for any reason or no reason, subject to applicable law.

Supplemental Terms

Certain services offered through the platform may be subject to additional terms, policies, or guidelines (“Supplemental Terms”). Such Supplemental Terms form part of this Agreement and will apply to your use of the relevant Services. In the event of any conflict between these Terms and the Supplemental Terms, the Supplemental Terms shall prevail with respect to the applicable Services.

Modification of Terms

The Company reserves the right to modify or update these Terms from time to time. Any changes will become effective upon posting the updated Terms on the platform. Your continued use of the Services following such posting constitutes acceptance of the updated Terms.

Eligibility

By accessing or using the Services, you represent and warrant that:

If you are entering into this Agreement on behalf of a company, organization, or other legal entity, you represent and warrant that you have the authority to bind that entity to this Agreement.

The Services are not available to individuals whose accounts have been suspended or terminated by the Company.

The Services

The Services constitute a technology platform, including websites and mobile applications (the “Platform”), that enables users to access a network of independent automotive service providers, including mechanics, technicians, inspectors, towing operators, and partner workshops (collectively, “Service Providers”) for vehicle inspection, diagnosis, maintenance, repair, towing, and related automotive services (“Vehicle Services”).

License

Subject to your compliance with these Terms, the Company grants you a limited, non-exclusive, non-sublicensable, revocable, and non-transferable license to access and use the Services solely for your personal or business use in accordance with this Agreement. Any rights not expressly granted herein are reserved by the Company.

Restrictions

You may not:

User Accounts

In order to access most aspects of the Services, you must register for and maintain a user account (“Account”). When registering an Account, you may be required to provide certain information, including your name, email address, address, mobile phone number, and vehicle information.

You agree to provide accurate, current, and complete information when creating your Account and to keep such information updated at all times. Failure to maintain accurate and complete Account information may result in your inability to access or use the Services, or in the suspension or termination of your Account.

You are responsible for all activity conducted through your Account and for maintaining the confidentiality of your login credentials. You agree to notify the Company immediately of any unauthorized use of your Account or any other breach of security.

Scheduling a Job

To request vehicle-related services (a “Job” or “Job Request”), you may be required to specify the type of service requested, the location where the service is to be performed, and the preferred date and time for the Job.

Service Location

Where the Technician performs the Job at your location, you shall be responsible for ensuring that the service location is safe, suitable, and legally permissible for the performance of the requested services, and that the assigned Service Provider has appropriate access and authorization to carry out the Job at the designated location.

Changes and Rescheduling

The Company reserves the right to modify pricing, service descriptions, or available options at any time prior to final billing. Any changes to a Job Request, including additional services, modifications, or rescheduling, must be documented through the Platform. Rescheduling or modification of a Job may be subject to additional fees.

User Responsibilities

You agree to treat Service Providers in a courteous and lawful manner and to provide a safe and cooperative working environment that complies with applicable laws and regulations. The Company does not guarantee the availability of any particular Service Provider.

Customer-Supplied Parts

You may choose to provide parts for installation as part of a Job. Where you supply parts for installation, any applicable limited warranty relating to such parts may be void. The Company shall not be responsible for any issues arising from parts supplied by the customer.

Vehicle Component Condition

Certain vehicle components may become fragile over time due to age, wear, and temperature changes. During repair or maintenance procedures, these parts may break or fail. You acknowledge that such failures may occur as a result of the condition of the vehicle and not due to negligence.

Communications

By creating an Account and using the Services, you consent to receive communications from the Company via email, telephone calls, text messages, and push notifications. You may opt out of promotional communications at any time using the unsubscribe instructions provided in such messages.

User Content

Users may be permitted to submit reviews, feedback, comments, or other content through the Platform (“User Content”). You retain ownership of any User Content you submit. However, by submitting User Content, you grant the Company a worldwide, perpetual, irrevocable, transferable, royalty-free, and non-exclusive license to use, reproduce, modify, distribute, display, and otherwise exploit such content in connection with the operation and promotion of the Services.

Payment Terms

Use of the Services may result in charges for vehicle-related services provided by Service Providers (“Charges”), which may include applicable taxes, assessment fees, diagnostic fees, and service fees.

By submitting a Job Request and scheduling a service, you agree to pay an assessment fee in advance at the time of booking. Payment of the assessment fee does not include any actual service work and is generally non-refundable, except as otherwise stated in this Agreement.

The Company facilitates payment to the relevant Service Provider on your behalf, and any payment made through the Platform shall be deemed equivalent to a payment made directly to the Service Provider.

Rescheduling and Cancellation

Vehicle Handling and Test-Drive Authorization

By using the Mechanic Africa Platform to schedule Vehicle Services or inspections, you authorize the Technician to handle, operate, and, if necessary, test-drive your vehicle solely for the purpose of performing the requested Service or inspection. You represent that your vehicle is insured and that you are responsible for notifying your insurer of any vehicle handling by a Technician, as may be required by your policy.

Termination

The Company may suspend or terminate your Account or this Agreement at any time, with or without notice, if you violate these Terms. You may terminate this Agreement at any time by ceasing all use of the Services and closing your Account, provided that there are no outstanding Jobs or unpaid Charges associated with your Account.

Inspection and Diagnostic Services

Inspection services are limited to observations that can reasonably be made by the Service Provider at the time of the inspection based on visible and accessible vehicle components. Inspection or diagnostic services provided through the Platform do not constitute a guarantee, warranty, or certification of the vehicle’s condition, value, or future performance.

Vetting of Technicians and Workshops

While the Company may perform vetting checks, the Company does not guarantee the accuracy, completeness, or reliability of any information provided by technicians or workshops, nor does it guarantee the quality, safety, or legality of the services they provide. The Company shall not be responsible or liable for the conduct, acts, omissions, negligence, or performance of any technician or workshop.

Disclaimer of Warranties

The Platform and all services made available through it are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, the Company makes no representations or warranties of any kind, whether express, implied, or statutory.

Limitation of Liability

To the fullest extent permitted by applicable law, the Company shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to the use of, or inability to use, the Platform. Where liability cannot be excluded by law, the Company’s total liability shall not exceed the amount paid by the user for the specific service giving rise to the claim.

Intellectual Property Rights

All copyright, trademarks, and other intellectual property rights in and relating to the Platform are owned by the Company or licensed to the Company by its partners. You must not copy, distribute, make available to the public, or create any derivative work from the Platform without the Company’s prior written consent.

Dispute Resolution

Any dispute arising out of or relating to these Terms or the use of the Platform shall first be resolved through good faith negotiations between the parties. Where the dispute cannot be resolved amicably, it shall be submitted to the courts of competent jurisdiction in Lagos State, Nigeria, which shall have exclusive jurisdiction.

Independent Service Providers

Technicians and workshops providing services through the Platform are independent contractors and are not employees, agents, or partners of the Company.

General Provisions

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The Company may update these Terms from time to time. Continued use of the Platform after such updates constitutes acceptance of the revised Terms.

Complaints and Questions

If you have any complaints or concerns regarding the Platform, Vehicle Services, or Service Providers, you should submit your complaint to the Company promptly using the contact information provided on the Platform. The Company will review complaints in good faith and, where possible, work to facilitate a resolution.

All complaints or questions should be submitted via the official support channels or by email to the Company’s designated legal or customer service contact, as listed on the Platform.
